By hereon we shall refer to the user of this website as "you" and the owners as "us" or "we". This Privacy Policy document describes in detail the type of data we use and collect. Data Deletion and GDPR requests can be submitted by emailing us or opening a ticket on our Discord.

If we make changes, we will notify you by revising the date at the top of this policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website or providing you with a notification). Information We Collect

We collect information you provide directly to us. For example, you share information directly with us when you create an account, sign up, fill out a form, purchase credits, communicate with us via third-party platforms, request customer support, or otherwise communicate with us. The types of personal information we may collect include your email address, login credentials, your content, including your generated responses, and any other information you choose to provide. Any data shared with us is not used for training or improvement of our platform or any AI app.

We do not collect payment information through our platform except for what is required to access your payment details. We rely on third parties such as Stripe to process payments in connection with our platform. Any information you provide to facilitate such a payment is subject to the third-party payment processor’s privacy policy, and we encourage you to review this policy before you provide any information to the payment processor.

Information collected by Cookies

We use tracking technologies, such as cookies, to collect information about you. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. The only cookie we use is a tracking cookie for interacting with you and to help with saving the login session, with the longest time of storage being 14 days.

Use of Information

We mainly use the information we collect to provide and maintain our platform, and improve our website. We use your email to communicate with you about updates, changes to the website, and release of new features. No information is shared with a third party for commercial purposes without your consent. We also use the information we collect to:

• Process transactions and send related information, such as confirmations, receipts, and user experience surveys;
• Send you technical notices, security alerts, and support and administrative messages;
• Respond to your comments and questions and provide customer service;
• Communicate with you about new content, products, services, and features offered by Pmfm.ai and provide other news and information we think will interest you (see Your Choices below for information about how to opt out of these communications at any time);

• Detect, investigate, and prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and protect the rights and property of Pmfm.ai and others;
• Debug to identify and repair errors in our Services;

• Carry out any other purpose described to you at the time the information was collected.
• Help with processing responses for your AI apps.
• Generated responses from apps are stored at the discretion of creators and can be viewed by them in their app analytics.

Your data is stored in an encrypted manner and it's deleted when you delete the apps. It's not used in training any other AI app or models, or shared with anyone else unless legally required.

If you are located in the European Economic Area (“EEA”), the United Kingdom, or Switzerland, you have certain rights and protections under applicable law regarding the processing of your personal data, and this section applies to you.

Depending on where you live and the laws that apply in your country of residence, you may enjoy certain rights regarding your personal data, as described further below. However, please be aware that these rights are limited, and that the process by which we may need to action your requests regarding our training dataset are complex. We may also decline a request if we have a lawful reason for doing so. That said, we strive to prioritize the protection of personal data, and comply with all applicable privacy laws.

To exercise your rights, you or an authorized agent may submit a request by emailing us at support@pmfm.ai. After we receive your request, we may verify it by requesting information sufficient to confirm your identity. You may also have the right to appeal requests that we deny by emailing support@pmfm.ai. Pmfm.ai will not discriminate based on the exercising of privacy rights you may have. Set out below is a summary of the rights which you may enjoy, depending on the laws that apply in your country of residence.

Rights You May Enjoy

• Objection: The right to object to processing of your personal data, including profiling conducted on grounds of public or legitimate interest. In places where such a right applies, we will no longer process the personal data in case of such objection unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise or defense of legal claims. If we use your information for direct marketing, you can object and opt out of future direct marketing messages using the unsubscribe link in such communications.
• Restriction: The right to restrict our processing of your personal data in certain circumstances.
• Withdrawal of consent: Where Pmfm.ai’s processing of your personal data is based on consent, you have the right to withdraw your consent. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
• Automated decision-making: Pmfm.ai does not engage in decision making based solely on automated processing or profiling in a manner which produces a legal effect (i.e., impacts your legal rights) or significantly affects you in a similar way (e.g., significantly affects your financial circumstances or ability to access essential goods or services).

Data Retention

We store personal data associated with your account for as long as your account remains active. If you close your account, we will delete your account data within 14 days. We store other personal data for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

Data Subject Requests

You have the right to request access to the personal data we hold about you and to receive your data in a portable format. To exercise this right, please email us at support@pmfm.ai with an appropriate subject or open a ticket on our Discord. We shall honor your request within 30 days of receipt.

Data Disclosure

We may share your Personal Data, including information about your interaction with our Services, with government authorities, industry peers, or other third parties in compliance with the law (i) if required to do so to comply with a legal obligation, or in the good faith belief that such action is necessary to comply with a legal obligation, (ii) to protect and defend our rights or property, (iii) if we determine, in our sole discretion, that there is a violation of our terms, policies, or the law; (iv) to detect or prevent fraud or other illegal activity; (v) to protect the safety, security, and integrity of our products, employees, users, or the public, or (vi) to protect against legal liability.

We may disclose Personal Data to our affiliates, meaning an entity that controls, is controlled by, or is under common control with Pmfm.ai. Our affiliates may use this Personal Data in a manner consistent with this Privacy Policy.

App creators retain access to conversation data from their users. App creators have the option to disable this access if they choose to do so.

Children

Our Services are not directed towards, and we do not knowingly collect, use, disclose, sell, or share any information about, children under the age of 18. If you become aware that a child under the age of 18 has provided any personal data to us while using our Services, please email us at support@pmfm.ai and we will investigate the matter and, if appropriate, delete the personal data.
